Background
The High Commissioner for Refugees is mandated by the United Nations to lead and coordinate international action worldwide for the protection of refugees and the resolution of refugee problems. UNHCR’s primary purpose is to safeguard the rights and wellbeing of refugees. In its efforts to achieve this objective, UNHCR strives to ensure that everyone can exercise the right to seek asylum and find safe refuge in another State, and to return home voluntarily. By assisting refugees to return to their own country or to settle permanently in another country, UNHCR also seeks lasting solutions to their plight. UNHCR’s Executive Committee and the UN General Assembly have also authorized UNHCR’s engagement with internally displaced people and people who are stateless or whose nationality is disputed.
UNHCR defines protection as “all activities aimed at achieving full respect for the rights of the individual in accordance with the letter and spirit of international law, including international human rights, refugee, statelessness and humanitarian law. Protection involves creating an environment conducive to respect for human beings, preventing and/or alleviating the immediate effects of a specific pattern of abuse, and restoring dignified conditions of life through reparation, restitution and rehabilitation.’
Policy framework
In October 2020, UNHCR released a Policy on the Prevention, Risk Mitigation and Response to Gender-based Violence, reiterating the agency’s work on GBV as a protection priority and institutionalised nine core actions to advance programming and coordination across the organisation. The Policy reiterates that BGV programming is lifesaving and an institutional priority for UNHCR.
The coverage of the Policy includes all UNHCR operations and persons of concern, and it is applied in all stages of the programme cycle, throughout the displacement continuum, in emergencies and protracted displacement settings, as well as in mixed flows and onward movements, and situations of statelessness.
In March 2018, UNHCR launched an updated Policy on Age, Gender and Diversity (ADG). Building on long-standing commitments and lessons learned, the policy aims to further enable displaced and stateless women, men, girls and boys to enjoy their rights on an equal footing, and to ensure that they are better able to participate fully in the decisions that affect their lives and the lives of their family members and communities. It includes five core actions on advancing gender equality and the empowerment of women and girls.
Areas of Focus
Creating safe environments and preventing, mitigating the risk, and responding to GBV is a high priority for UNHCR. Therefore, UNHCR continues to establish safeguards against such violence for all people of concern and works to ensure that response interventions are accessible for all survivors for GBV.
The implementation of UNHCR’s Policy on the Prevention, Risk Mitigation and Response to Gender-based Violence, has institutionalised UNHCR’s work on GBV through two objectives: a) risk of GBV is reduced for all PoC and b) all survivors have adequate and timely access to quality services and nine core actions to enable the three programme areas of prevention, risk mitigation and response as well as assessment, monitoring and reporting, planning, prioritisation, and resource allocation. The Policy also highlights the implementation of core global standards and guidelines including the GBV Minimum Standards.

In 2016, UNHCR established response mechanisms to people fleeing from conflicts and crises in various parts of the world such as Uganda, Tanzania, Rwanda, CAR, Niger and Nigeria. With the continued flow of refugees to many of the mentioned countries, UNHCR operations have sought to swiftly increase and strengthen the SGBV response and assistance. UNHCR has worked together with partners, including refugees, with the aim of ensuring the provision of accessible, prompt, confidential and appropriate multi-sectoral services (safety, legal, psycho-social and medical) to survivors, establishing referral pathways and coordination mechanisms, recording cases on the GBVIMS and reducing of risk of SGBV through prevention and outreach activities. Although challenges persist, UNHCR continues to work to enhance community participation in SGBV programming and towards the empowerment of survivors.
In June 2016, UNHCR held its NGO Annual Consultations with a thematic session on “Youth Addressing Sexual and Gender-Based Violence, Challenges and Opportunities”. The session placed youth at the centre of the discussion and provided a platform to exchange innovative ways to prevent and respond to sexual and gender-based violence (SGBV). Refugee and internally displaced youth face SGBV, including domestic violence, child marriage, and survival sex. Topics discussed included how diverse youth are taking action to prevent and respond to SGBV and how UNHCR and NGO partners can better involve and support youth in their work to prevent and respond to SGBV. The importance of including survivors, persons with disabilities and sexual minorities into efforts and how to work to better integrating these groups was also discussed, in addition to how can we work together to engage men and boys in SGBV prevention and response.
In 2016, a regional workshop was held in Kenya on Community Engagement in Sexual and Gender-Based Violence (SGBV) Prevention and Response emphasizing the importance of community based protection and its impact on SGBV. The event was organized in partnership with the Council of Kenya who launched the outcome of their research projects conducted in Uganda. The event sought ultimately to strengthen SGBV prevention and response programming through systematic and active community engagement. The aim was also to strengthen and facilitate technical exchange and information-sharing among UNHCR and Partners in the region. The workshop discussed findings from relevant baseline reports. The “Zero Tolerance Village Alliance Intervention”, a community based SGBV prevention model found to be effective in emergency settings, highlighted important issues with implications for SGBV programming in emergency settings in sub-Saharan Africa. Issues discussed included gender attitudes and beliefs amongst women and men, the concept of rape and physical violence against both men and women, the consequences of low levels of formal education and justifications for gender based violence.
UNHCR's Guidelines on International Protection No. 12 on Claims for Refugee Status Related to Situations of Armed Conflicts and Violence, issued in December 2016, provide substantive guidance for assessing claims to refugee status related to situations of armed conflict and violence in accordance with the 1951 Convention and 1967 Protocol as well as the broader regional refugee criteria. Specific reference is made to refugee protection from sexual and gender-based violence as this common is a form of persecution in many situations of armed conflict and violence. UNHCR was actively engaged in the revision of the IASC Guidelines for integrating Gender Based Violence interventions in humanitarian settings published in 2015 and supports the roll-out of the guidelines in the field. In 2016, 11 pilot countries receive training and technical support.
In Egypt, the provision of support to SGBV survivors among Syrian refugees includes a shelter and the use of creative approaches to psychosocial support. Female survivors have access to women’s centers where awareness raising, counselling and psychosocial support is made available. Special projects and approaches were put in place, such as the individual and group art therapy focusing on issues such as child marriage, training of trainers (ToTs) on art therapy.
UNHCR is a founding member of the Gender-Based Violence Information Management System and sits on its Steering Committee along with UNFPA, IRC, IMC and UNICEF. UNHCR is working to strengthen and harmonize data collection on SGBV by implementing the GBVIMS in selected operations. In 2015, UNHCR provided technical support in data collection and analysis to 22 countries.
In 2015, UNHCR conducted 6,995 awareness raising campaigns on SGBV prevention and response and 2,188 community-based committees/groups were working on SGBV prevention and response.
UNHCR is a member of the Call to Action on Protection from Gender Based Violence in Emergencies and contributed to the Call to Action’s five-year roadmap that reflects collective goals and focuses on the systemic changes that must be made in policy and practice to transform humanitarian response to SGBV. The Call to Action is a multi-stakeholder initiative that aims to transform the way SGBV is addressed in emergencies, so that every humanitarian response provides safe and comprehensive services for those affected by SGBV and mitigates SGBV risk from the earliest phases of a crisis. UNHCR has made ten commitments aimed at changing UNHCR’s internal institutional policies, improving inter-agency systems, and implementing SGBV prevention and response programmes from the onset of emergencies.
Compared to the previous year, in 2015 significantly greater levels of assistance were provided to survivors across a range of key core services: psychosocial counselling was provided to survivors in 27,616 reported SGBV incidents (38% increase compared to 2014); legal assistance in 7,342 reported incidents (31% increase); medical assistance in 4,518 reported incidents (7% increase); material assistance in 5,542 reported incidents (27% increase); and safe spaces in 3,948 reported incidents (50% increase). Additionally, over 6,000 survivors were enrolled in income generating and occupational activities doubled the number enrolled in the previous year.
